RE: CLS500 Transmission problems anyone?

We have had a problem with our CLS 500 since day one. MB replaced something back when the car was new regarding the ESP light and the car jerking when downshifting. When I picked up the car, the light was fixed but the car was still downshifting hard. I called the service department and told him the car still did not feel right but I agreed to drive it longer and see if I could describe when and how it would feel weird. I let time pass because I became used to the car feeling that way, however, we continued to have more problems and after 5 visits to the shop they told me they needed to replace the transmission. Since replacing the transmission, the car is MUCH worse. Before, the car would make a sharp downshift but now the car just jerks when accelerating from first to second to third, etc., and is really noticeable when going up a hill and around corners. MB finally agreed to buy back the "lemon" but are asking us to pay an arm and a leg for a usage fee. They claim that the problem just started (10 months after owning the car) even though I have been complaining about it since day one. My service person admits I have complained since day one and the sales person who sold us the car has acknowledged we told him about the jerking the car made since day one. The problem is that my service person never noted half of my complaints and only recorded it after I put 12,000 miles on the car. They want us to pay for usage up until the correct problem was recorded in their system. I had no idea that it was the transmission (I'm not the mechanic). We are in a heated battle with MB corporate over how to proceed. Any one have any advise for us?
